The following is a transcription by CATindell done in 2001 from a photocopy of the original record found at the Courthouse in Murphy, Cherokee Co., NC.  This grant was recorded within the 12 months allotted...it was re-recorded in 1875 after a courthouse fire. This same land was later deeded to his children because he was then living in neighboring Polk Co., TN.  Joseph was also known as Josephus or Josiah.

Know ye, that we, for and in consideration of the sum of thirty-five dollars [$35]and that is paid into the Treasury by Joseph BROOKS haven given, and granted and by these presents do give and grant unto Joseph BROOKES a tract of land containing 175 acres, lying and being in the County of Cherokee, Section No. 93, in District No. 8; it being a part of the land lately acquired by Treat from the Cherokee Indians and said in obedience to an act of the General Assembly of this state bounded as follows, viz:

Beginning at white oak in a flat hollow, the Southwest corner of 92 and runs West 175 poles to a large black oak in the line between this state and the state of Tennessee, then North with said line 160 poles to a state; thence East 175 poles to a black oak; then South 160 poles to the beginning.

ENTERED March 2, 1838

As by the plat hereunto annexed doth appear together with all woods, waters, mines, minerals, hereditaments and appurtenances, to the said land belong or appearing. To hold to the said Joseph BROOKES his heirs and assigns forever, providing and paying to us such or money yearly or otherwise as our General Assembly from time to time may direct: Provided Always, That the said Grantee shall cause this grant to be registered in the Registers Office of Cherokee County within twelve months from the date hereof, otherwise the same shall be void.

In Testimony Whereof, We have caused these our letters to be made patent, and our great seal to be hereunto affixed.

W.W. Holden, Esq., our Governor, ____tain General and Commander-in-Chief at Raleigh the 29th day of August in the 93d year of our Independence, and in the year of our load one thousand eight hundred and sixty eight.
