The following is a transcription by CATindell done in 2001 from a photocopy of the original record found at the Courthouse in Murphy, Cherokee Co., NC. Lewis P[ayne] DAVIS was 1st husband of Mary Ann BROOKS, sister of Adolphus BROOKS, the Grantor.

This Agreement witnesseth that for and in consideration of the sum of One
Hundred and Fifty Dollars [$150.00] to us in hand paid, we Adolphus BROOKS and
wife, Lucinda, have this day bargained, sold and by these presents do bargain,
sell and convey until Lewis P. DAVIS a certain piece and parcel of land being
and lying in the County of Cherokee and State of North Carolina and in Shoal
Creek Township on the waters of Laurel Branch part of Tract No. 93 bounded as
follows:
Beginning on a popular Northeast corner of said No. 93, 175 poles to a pine on the State line on original corner of said No.; thence South with said State Line near a branch to a chestnut oak, conditional marked corner; thence East up the ridge to the Laurel Branch, corner on a marked maple, conditional corner; thence down the said Laurel Branch to the mouth of small branch; thence Southeast to the top of a hill to a Hickory marked conditional corner; thence with a conditional line down the ridge to a branch so as to incline water to a stake on the original line of said No. 93; then North with said line to the beginning corner; containing 85 acres more or less.
To have and to hold the same we bind ourselves, our heirs and assigns to warrant
and defend the title of the same to the said Lewis P. DAVIS, his heirs and
assigns forever, with all woods, ways, waters, mines and minerals with all
appurtenances thereto belonging or appertaining.
In Witness whereof, we have hereunto set our hands and seals on this the 29th
day of January, 1884.

I, J. P. BURNETT, one of the Justices of the Peace for Cherokee County, do
hereby certify that the foregoing deed of conveyance was duly proven by the oath
of Joseph BROOKS as to the assignment of Adolphus BROOKS and Lucinda BROOKS,
wife of said Adolphus BROOKS, was by me privately examined separate and apart
from her said husband and that she doth state that she executed the same freely
and voluntarily without fear or compulsion from her said husband or any other
person, and that she doth still assent thereunto.
Given under my hand and seal this 29th day of January 1884.

The foregoing certificate of J.P. BURNETT is adjudged sufficient. Let the
foregoing deed with certificates be registered. This April 18th, 1888.
