The following is a transcription by CATindell done in 2001 from a photocopy of the original record found at the Courthouse in Murphy, Cherokee Co., NC.  James W. TORRANT/TORRANCE was married to Nancy A. BROOKS on 5/25/1871 in Cherokee Co. This deed is found in Book 15 page 182 in the Register of Deeds office. It needs to be checked against the deed recorded in the Probate section of the courthouse as this deed was made in connection with an Estate administration.  Witnesses, Adolphus and Mary E. Brooks, were siblings to Nancy Brooks.  James and Nancy are buried at Shoals Creek Cem. in Cherokee Co., NC.

KNOW ALL MEN BY THESE PRESENTS that I, Joseph BROOKS, of the state and county aforesaid, have this day bargained and sold, aliened and conveyed and by these presents do bargain sell and convey unto JAMES W. TORANT of the County of Polk, State of Tennessee, for the consideration of the sum of Three Hundred Dollars [$300.00] to me in hand paid by him and said TORRENCE for a certain piece or parcel of land lying and being in the county and state aforesaid, in District No. 8 and part of Tract No. 102 bounded as follows:

Beginning on a Spanish oak; thence run North of East to a post oak a conditional line; then West of North to a post oak on top of a ridge a marked conditional line; then along the top of said ridge to the North boundary line of said tract to a hickory; then West to a hickory the North West corner of said tract or lot; thence South 160 poles to a black oak; then East to the beginning. The West and aforesaid lot is supposed to contain 75 acres more or less.

TO HAVE AND TO HOLD to the said James TORRANT, his heirs and assigns forever, the said Joseph BROOKS hereby binds himself, his heirs, administrators, executors and assigns, jointly, severally and firmly by these presents to warrant and defend the said land unto the said TORRANT with all woods, waters, mines & minerals and all the appurtenances and hereditaments belonging or in any wise appertaining. To have and to hold to said TORRANT, his heirs and assigns forever.

IN WITNESS WHEREOF, I have hereunto set my hand and seal this October 7th 1874.

The execution of the foregoing deed was the date hereof duly acknowledged before me by Joseph BROOKS, the maker thereof for the purposes therein contained. Therefore, let the said deed and this certificate be recorded, Book B, page 214.
