The following is a transcription by CATindell done in 2001 from a photocopy of the original record found at the Courthouse in Murphy, Cherokee Co., NC. This deed was indexed under the name of JOSIAH Brooks, yet the deed itself shows Joseph Brooks. This deed was recorded in Book W, page 453. This isn't the first time that I have seen these first names interchanged. In this particular deed, it is believed that this Joseph/Josiah Brooks was the Jr. and brother of Adolphus BROOKS both of whom later resided in Ducktown, Polk Co., TN. Adolphus was a medical doctor for the TN Copper Co.

This Agreement witnesseth that for and in consideration of the sum of Two
Hundred Dollars [$200.00] to us in hand paid, the receipt where of is hereby
acknowledged, we, ADOLPHUS BROOKS and wife LUCINTHA have this day bargained,
sold and conveyed and by these presents to bargain sell and convey unto Joseph
BROOKS a certain piece and parcel of land lying in Cherokee County and State of
North Carolina in Shoal Creek Township on the waters of Laurel Branch bounded as
follows:
Beginning on a chestnut oak on the State line, then South said line to a stake the original corner of lot No. 93; thence East 175 poles to a white oak original corner of aforesaid No. 93; then North with said line to a stake on the branch condition line to the Laurel Branch, then up said branch to a marked maple conditional corner; then West to the Beginning corner containing 90 acres more or less.
To have and to hold the same, we bind ourselves, our heirs and assigns to
warrant and defend the title of the same with all woods, waters and ways, mines
and minerals with all appurtenances thereto belonging or appertaining.
In Witness Whereof, we have hereunto set out hands and seals this 29th day of
January, 1884.

I, J.P. BURNETT, one of the Justices of the Peace for Cherokee County, do hereby
certify that the within deed of conveyance was proven by the oath of Joseph
BROOKS as of the assignment of Adolphus BROOKS and Lucintha BROOKS, wife of said
Adolphus Brooks, was by me privately examined separate and apart from her said
husband and that she doth state the she executed the same freely and voluntarily
without fear or compulsion from her said husband or any other person and that
she doth still assent thereto. Given under hand and seal this 29th day of
January 1884.
